宗主权

宗主权(英语:suzerainty)是指一个国家代表其属国附庸国处理外交事务的权力,[1][2]宗主权下,属国对其内政仍具主权(或称自治)。[3][4]行使这种权力的国家普遍被称为“宗主国”。[5]

定义 编辑

“宗主权”原是指封建领主对诸侯行使之权利,当时领主被视作封臣的“宗主”。[6]现代国际法体系成型后,“宗主权”一词就用来介定奥斯曼帝国及属国的关系。

与主权下的领土属土不同,宗主权下的属国对内政仍拥最高权力。[3][4]个别例子中,属国甚至具一定程度“国际法人”(International personality)的身份,能就通邮、通商、兴建铁路等非外交事宜,直接与外国签订条约[7]学者普遍认为,用现代国际法去解释宗主和属国的关系具一定难度。[8][9]

中国 编辑

藩属国是藩国和属国的合称,历史上中国主张自身是天下的中心,周围国家承认中国的宗主地位,中国则为其提供保护。例如越南朝鲜等。即使在天下分治时期,中国政治理论通常仍只承认统治中原的君主具有正统的地位(如曹魏西晋前秦北魏北周五代北宋等)。

理论上,藩属国从中国皇帝身上得到治权,但中国皇帝对从属国的影响力因朝代而不同。藩属国常以“进贡”之名行贸易之实。属国进贡后中国常还以等值或更多的礼物,其价值往往远远超过朝贡者所进贡的物品。荷兰葡萄牙等欧洲殖民国家在早期也以朝贡的名义来华贸易。但这套系统在18世纪之后便逐渐衰败,因清朝皇帝以不同的权力理论统治各族,并开始区分实质统治的地区(藩部)和名义上称臣纳贡的“藩属国”(也称“册封国”或“朝贡国”)。西方势力进入中国之后,国际法的思想及加速其瓦解。[10]

欧洲国家常用宗主关系和有限主权论,形容清朝和其周边国家的关系。譬如李氏朝鲜越南阮朝等等。向中国朝廷朝贡的国家,因中国并不能干预其对外交往,被国际法视为独立国家[11]

朝鲜 编辑

李成桂立国之始,就派使节到明朝,拟两个国号方案“朝鲜”(古朝鲜国名)和“和宁”(李成桂之父李子春就仕之地)奏请明太祖朱元璋裁定,朱元璋圈定朝鲜二字,于是开始以“朝鲜”为国名。朝鲜是明朝清朝的藩国,直至中日甲午战争为止。

越南 编辑

阮朝嘉隆帝立国之始,便派使到清,自称为“南越国长”求封为“南越国王”,清朝嘉庆帝不认同“南越”二字,改封阮福映为“越南国王”,于是开始以“越南”为国名。

缅甸 编辑

元朝政府设置缅中行省,管理缅甸东北部地区后并入云南行中书省。明朝中叶后一度断绝来往,直至乾隆十五年(1750年)遣使往来,纳贡求封。

琉球 编辑

琉球国对中国明朝称藩属,后同时向日本萨摩藩纳贡。1879年并入日本,改称冲绳县

尼泊尔(廓尔喀) 编辑

1790年廓尔喀入侵西藏乾隆帝两广总督领兵入藏增援。1792年中,清军攻入廓尔喀境内并逼近加德满都,廓尔喀最后遣使求和。此战之后,廓尔喀成为中国的属国,并“定下五年一贡之制”。[12]

泰国(暹罗) 编辑

暹罗康熙年代开始向中国进贡,1767年,暹罗首都被缅甸攻陷,国王被杀。后来,华侨郑昭成功击退缅甸军队,被推举为王,迁都曼谷,继续向中国朝贡。后来大将帕佛陀约华朱拉洛篡位,号称拉玛一世,并遣使中国接受册封。[12]

锡金(哲孟雄) 编辑

1791年,中国出兵支援锡金对抗廓尔喀。廓尔喀战败后,清代西藏暂时确立了对锡金的控制。[13]

浩罕 编辑

与邻国连年交战,加上清军压境,1758年浩罕君主伊尔达娜向阿富汗国王求援未果后,接受中国宗主权,成为大清属国。[14][15]

其他 编辑

按照《清史稿》的记载,中国的属国或朝贡国,还包括南掌、苏禄、阿富汗、兰芳、拉达克、不丹坎巨提等等。[16][17]

具争议例子 编辑

西藏 编辑

中华人民共和国西藏拥有主权并实际管治至今,但西藏独立运动人士认为中国历史上对西藏只有宗主权,从未曾实际统治西藏。

7世纪至9世纪,吐蕃是个独立的帝国,和中原王朝的唐帝国成互相结盟的平等关系,与唐朝在今中国西北维持长达两百多年的军事对峙;在时期由于蒙古经略、藏传佛教萨迦派对蒙古贵族的号召力,双方凉州会盟,使得元朝统治者在西藏行使治权,西藏成为宣政院辖地。1720年之前西藏被认为是一个独立的藩属国,但是1720年后,清朝派驻驻藏大臣,对西藏的掌控日益加强。20世纪初,随着西方列强的入侵,亲英反清集团在清朝灭亡后迅速联合英国驱逐满汉官员,但新成立的中华民国政府并未承认西藏独立。

清朝政府长期地治理过西藏:[18][19]清政府18世纪率军驱除入侵西藏的蒙古准噶尔汗国军队,从此继清朝后继续驻军西藏,并在西藏设有驻藏大臣进行实际上的管理。清政府并在19世纪与20世纪时与大英帝国签定过《中英藏印条约》、《中英续订藏印条约》等涉藏条约。自由亚洲电台史学研究员华伦史密斯指出1906年《中英续订藏印条约》条文变相承认中国对西藏主权, [20] 但其他同情藏独人士认为中国对西藏只有宗主权,从未因此可以解释为西藏不是中国的一部分。1907年《英俄条约》虽有“承认中国对西藏宗主权”之条款,[21][22] 但由于中国并非签署国,条文对北京并没有约束力。[23]

1911年辛亥革命后,拉萨发生第一次驱汉事件第十三世达赖喇嘛于1913年宣布西藏独立[24][22],其后更传出蒙藏互认独立的消息,但十三世达赖喇嘛与西藏政府否认,未对此表示认可。 [25] 虽然西藏表面上顺从国民政府,并派遣国大代表进入南京,但西藏从1912年到1949年一直处于中华民国治权鞭长莫及的,因中华民国和英国的协议,英国不把势力范围进入西藏,但中国亦无法从军事上控制西藏,西藏处于实际独立状态。直到1951年解放军进军拉萨后,中华人民共和国中央政府控制西藏,使中国正式全面控制统治西藏。

2008年10月29日,英国外交大臣戴维·米利班德David Miliband)正式宣布,英国承认中华人民共和国西藏的主权。美国与欧盟也承认中华人民共和国对西藏的主权。 [26]

外蒙古 编辑

1913年《中俄声明文件》(连《附件》)与1915年《中俄蒙协约》先后承认中华民国对外蒙古之“宗主权”,但两份文件亦指外蒙古“为中国领土一部分”。[27][28] 条文解释与当时一些西方学者对“宗主权”的定义存在出入。1924年《中苏解决悬案大纲协定[29]更直认外蒙古为“完全中华民国之一部分,及尊重在该领土内中国之主权”。

印度 编辑

锡金王国 编辑

紧接着印度1947年的独立,锡金却嘉印度总理贾瓦哈拉尔·尼赫鲁签订了一个宗主条约。此条约确定锡金为印度的保护国,以换取锡金王国的自治,直到1975年锡金王国的君王被废黜锡金现为印度人口最少的邦。

不丹 编辑

印度现今虽已不干涉不丹外交国防、通讯等方面,但印度仍提供不丹皇家军队很大的协助,并承诺抵御外侮。

拉克沙群岛 编辑

位于阿拉伯海上,喀拉拉邦西南方的拉克沙群岛是印度最小的联合属地。蒂普苏丹于1787年,统治雅敏迪维群岛(Amindivi)(包含雅敏尼(Amini)、喀德马(Kadmat)、契珥单(Kiltan)、察他喇(Chetlat)及比差(Bitra))。在第三次英祢战争(Third Anglo-Mysore(迈索尔)War)后治权转移至英属印度的南卡纳达区。其他的岛屿成了肯诺(Cannanore)的阿剌克家族(Arakkal)的进贡国。之后英国因阿剌克的欠款接管了这些地区、依附在马德拉斯省下的玛拉巴(Malabar)区。印度1956年的国家重组法中,将这些岛屿从印度本岛行政单位中划出,结合所有小岛成立新的领域联盟。

奥斯曼帝国 编辑

埃及 编辑

1517年,奥斯曼帝国塞林一世征服埃及,并将之纳为行省。19世纪初,埃及成为奥斯曼帝国之藩属,在土耳其宗主权下,埃及在国际社会中仍拥有很大活动空间,在毋须知会宗主国情况下,能直接跟外国签署通邮和通商条约。[7]

保加利亚 编辑

根据1878年《圣斯特法诺条约》和《柏林条约》成立的保加利亚大公国,法律上是奥斯曼帝国的附属国,[30]但在奥斯曼帝国宗主权下仍有很大国际活动空间,可直接与外国就通邮和通航等议题签订条约。[7]

英国 编辑

南非 编辑

1881年第一次布尔战争结束后,英国南非共和国签署《比勒陀利亚公约》,除确立英国对南非之宗主权外,亦承认南非的“完全自治”地位。根据《比勒陀利亚公约》,英国能于南非境内自由调动军队,并控制南非的对外关系,包括缔结条约及与外国进行外交往来。[31]

两国于1884年签订《伦敦公约》,取代《比勒陀利亚公约》。《伦敦公约》容许南非在毋须英国批准下直接与奥兰治自由邦缔结条约。[32]至于与其他国家所签订之条约则仍须交付英国审批,但英方须于六个月内作出决定并知会南非。[33]

其他 编辑

在现今的国际关系中,大国控制或者代理小国的外交和国防存在的事实。通常,这和传统宗主不同处,在于弱国可以通过公民投票取消这关系。
