de jure拉丁语dē iūre发音:[deː ˈjuːrɛ]英语发音:/deɪ ˈdʒʊəri, di -/ day JOOR-ee, dee -⁠),中文译作法律上名义上法理上,是来自拉丁语法律术语,与de facto(事实上)相对。[1]

在英语中,它表示“法律上规定的情况”,尤其是虽有规定但实际上并非如此的情况。虽然De Jure是法律用语,但是有时候也会在法律以外的语境下使用。[2]此词使用时绝大多数时候都会与de facto并列,以突出理想与现实的差别。此词语通常以形容词方式使用、以斜体字书写。[3]在商业上,De Jure也会用来形容满足所有法律要求、已经正式成立的有限责任公司。在某些司法管辖区,即使没有满足成立公司相关的要求,实务上存在的公司也可能获得责任限制的保护(de facto protection)。[4]
