罗斯·乌布利希

罗斯·威廉·乌布利希(英语:Ross William Ulbricht,1984年3月27日)是一名美国罪犯,因于2011年创办了暗网市场丝路而知名于世。乌布利希于2013年被捕之前一直营运著“丝路”网站[3],该网站为确保匿名性,在设计上只允许透过Tor访问,并仅以比特币作为交易介质[4][5]。他的网名恐怖海盗罗伯兹英语Dread Pirate Roberts取自《公主新娘》(The Princess Bride)及其改编电影中的同名角色。

2015年2月,乌布利希被美国当局控以洗黑钱电脑入侵、串谋贩毒、串谋贩运虚假身份证明文件等罪[6]。2015年5月,法院判处乌布利希双重无期徒刑,40年内不得假释。后来,他先后把案件上诉至美国联邦第二巡回上诉法院(2017)和美国最高法院(2018),但两度皆上诉失败[7][8][9]。他现于亚利桑那州图森监狱英语United States Penitentiary, Tucson服刑[10]

早年经历 编辑

乌布利希早年住在奥斯汀市区。幼时是一名童军[11],并成功获颁鹰级童军[12]。他先后就读位于奥斯汀附近的西部山脊中学(West Ridge Middle School)和西湖高中(Westlake High School)[13],2002年从高中毕业[14]

他之后凭着全额奖学金就读得克萨斯州大学达拉斯分校[12],于当中修读物理,最后于2006年成功获取学士学位[14]。接下来他开始在宾夕法尼亚州立大学修读材料科学与工程硕士课程,并研究晶体学。在乌布利希成功获取硕士学位之前,他就已对自由意志主义的经济理论产生强烈兴趣。比方说,他会支持路德维希·冯·米塞斯荣·保罗的主张,并在校园参与有关经济意识形态的辩论[13][15]

乌布利希于2009年成功获取硕士学位,并决定回到奥斯汀居住。此时他发现正规工作跟自身的个性不合,故打算自行创业。不过他的第一门事业以失败告终。他曾试过以日內交易的方式赚钱,亦曾开过一间电子游戏公司。乌布利希的母亲称,他的LinkedIn文件并没有提及暗网市场,反而更让人认为他在营运著一款大型多人在线角色扮演游戏,上面写道:“我正在制作一款经济模拟器,它能让人们亲身体验一下活在没有系统性武力的世界是怎样的”[16]:7:20

丝路、被捕与审判 编辑

丝路运行在Tor之上,并以比特币作为交易介质。Tor是一个运用加密协议的暗网网络,它使得网络流量在到达目的地前经由全球志愿者免费提供的服务器路由,以达至隐藏用户真实IP地址的目的。故此乌布利希能透过把自身的网站以Tor站点的方式营运,来隐藏自身的IP地址[4][5]比特币则是一款加密货币;虽然所有的比特币交易都会以区块链的形式记录下来,但由于它不会把用户身份跟其在线钱包联系到一起,故同样能够在一定程度上确保匿名性[17][18]

乌布利希在丝路上的网名为恐怖海盗罗伯兹(Dread Pirate Roberts)。不过他是否此账户的唯一用户这道问题便有一定争议[19][20]。恐怖海盗罗伯兹表示,此一网站的灵感源自“《Alongside Night》和塞缪尔·爱德华·康金三世英语Samuel Edward Konkin III的作品”[21]

自2010年起,乌布利希便开始着手于建立他的在线市场,视之为在线二手书店的副业。在营运过程中,他还不时在网上发表自身所写的日记;他在第一篇日记中稍微写了一些过往经历,并预测他能透过这次创业,使2011年成为“好景之年”[13][22]。乌布利希在其LinkedIn页面上可能稍微暗示过自身跟丝路的关系,他于上面提到了自身的愿景:“以经济理论来消弭人与人之间的胁迫和侵略”,并指:“我正在制作一款经济模拟器,它能让人们亲身体验一下活在没有系统性武力的世界是怎样的”[15]。他之后移居至旧金山[15]

2013年,美国国家税务局的调查人员加里·阿尔福德(Gary Alford)在跟美国缉毒局一起调查丝路时,首次把网名恐怖海盗罗伯兹跟乌布利希划上联系[23][24]。他首先发现丝路早期用于发布通知的用户为奥托伊德(altoid),然后在另一论坛上找到由同一名称的用户发出的帖文。于是他遵从此一线索,透过程序找出他的电邮地址。电邮地址上包含了他的全名[23]。2013年10月,美国联邦调查局在旧金山公立图书馆格伦公园(Glen Park)分馆正式拘捕乌布利希,并指控他为网站的“幕后主脑”[25][26][27]

为了使乌布利希不能够把笔记本电脑内的有关文件删除或加密,两个探员先假装成情侣,然后在他身旁大吵大闹,使之分神[28]。随后第三个探员上场,一手夺走他的电脑,再把之交给探员托马斯·基尔南(Thomas Kiernan)[29]。基尔南把一只USB设备插进乌布利希的电脑,然后透过软件复制关键文件[28]

2014年8月21日,乌布利希正式被落案起诉,罪名为洗钱、电脑入侵、串谋贩毒[30]。法庭下令他在等候审讯期间需还押看管[27]

乌布利希在经过2015年1月的陪审团审判后,于2015年2月4日被裁定所有罪名成立[31]。2015年5月29日,法院判处乌布利希双重无期徒刑,40年内不得假释[32][33]

联邦检察官还称,乌布利希曾雇用杀手去尝试杀掉至少5个人,涉及金额达73万美元[27]。这样做的背后动机据称是为了让自身营运着丝路的真相不被发现[34][35]。检察官认为,当中没有一单是真的成事的[27]。尽管在纽约联邦法院的审判当中,它并没有控以乌布利希相关罪名[27][36],但呈堂证据支持上述指控[27][35]。 法官在判处乌布利希无期徒刑时,考虑到了有关他雇用杀手的证据。第二巡回上诉法院在决定维持原判时亦考虑了有关因素[35]美国马里兰联邦地区法院曾对乌布利希提出单独起诉,指控他雇凶杀害他的一名雇员。不过在2018年7月,最高法院决定再度维持原判后,有关起诉被检察官无条件驳回[37][38][39]

定罪后 编辑

乌布利希于2016年1月向美国第二巡回上诉法院提出上诉。上诉方主要认为检方非法隐瞒了美国缉毒局探员在调查丝路时,参与渎职行为的证据。之后两名探员因此而被定罪[40]。乌布利希还认为他的判刑过重[41][42]。口头辩论于2016年10月进行[43][35][44]。2017年5月,第二巡回法院判处乌布利希上诉失败,法官杰拉德·林奇(Gerard E. Lynch)为此择写了一份意见书[35],长达139页[35]。当中法院判断地区法院否决“乌布利希排除某些非法证据的申请”的决定是正确的;接纳了地区法院的专家证供和发现;驳回了乌布利希有关判决过重的论点[35][44]

2017年12月,乌布利希向美国最高法院提出呈请,要求法院就证据和量刑问题审理他的上诉[45][46]。21个法院之友向法院提出了5份意见书,以支持乌布利希的呈请,其中包括全国律师协会英语National Lawyers Guild、美国黑十字会(American Black Cross)、理性基金会英语Reason Foundation药物政策联盟英语Drug Policy Alliance、缩小DC基金会(Downsize DC Foundation)[47]。美国政府提交了反对乌布利希呈请的回应书[47][48]。2018年6月28日,最高法院驳回了乌布利希的呈请[49]

2019年,乌布利希的辩护律师以无效辩护(ineffective assistance of counsel)为由,尝试去撤销无期徒刑此一处罚;2019年8月,申请被驳回[50]
