依據著作權法規定，簡單照片為「從攝影或類似方式獲得的人物、自然或社會生活的環節、元素或事件照片，包含複製具象藝術作品與電影劇照（著作權法第87條）。」

如果本影像符合簡單照片的定義，於1976年以前出版，且沒有於1989年3月1日前標注版權，則該照片在回溯日期起，於意大利不受版權保護，且在美國處於公有領域（美國法典第17編第104條）。
