福克兰群岛LGBT权益

英国海外领土福克兰群岛女同性恋、男同性恋、双性恋、跨性别（LGBT）群体享有的权益大部分与非LGBT群体相同。2017年4月29日起异性与同性的婚姻及民事伴侣关系皆为合法。宪法禁止基于性取向的歧视，民间大多亦持积极态度，修法前的公众咨询发现90%的受访者支持同性婚姻。

福克兰群岛的同性性行为自1989年合法，同意年龄自2005年统一为16岁[1]。

福克兰群岛最初不愿在当地法律正式承认同性伴侣关系[2]。

2015年5月13日，检察总长建议行政委员会（英语：Executive Council of the Falkland Islands）考虑同性婚姻或民事伴侣关系合法化[3]。2016年1月13日，委员会经公众咨询后指示检察总长准备《1996年婚姻条例》（Marriage Ordinance 1996）修正案，以允许同性婚姻[4]。公众咨询发现90%的受访者支持同性婚姻，94%的受访者支持所有伴侣建立民事伴侣关系[5]。

检察总长的修正案草案于2017年2月22日由行政委员会审议。委员会考虑批准同性婚姻合法化及允许同性、异性伴侣建立民事伴侣关系的法案，指示检察总长发布官方公报，从而开始一读立法程序，并准备实施所需的后续立法[6]。

2017年3月30日，立法议会以7票同意对1票反对通过同性婚姻法案[7][8][9][10]。该法案允许同性伴侣结婚，并允许同性与异性伴侣建立民事伴侣关系[11][12][13][14]，于2017年4月13日获总督柯林·罗伯茨御准[15][16]。新法律称为《2017年婚姻（修订）法令》（Marriage (Amendment) Act 2017），2017年4月29日生效[17]。庆祝同性婚姻合法化的社群活动在同日举行[18][19]。

2017年修订后的《1996年婚姻条例》第3A与3B条规定[20]：

2017年婚姻及民事伴侣关系相关法律改革后的《婚姻条例》规定“民事伴侣关系中之父母……对子女拥有等同婚姻中之父母对子女之权利及责任”。该条例修正案所附的官方理由包括一条注释，指出“……子女之父母，可为两母或两父”[9]。

反歧视保障 编辑

2008年宪法（英语：Constitution of the Falkland Islands）第16条禁止基于性取向的歧视[22]：

本节之“歧视”一语，系指基于性别、性取向、种族、肤色、语言、宗教、政治或其他见解、民族或社会出身、与少数民族之联系、财产、出生等任何理由，对不同人给予不同待遇。

《2014年刑事罪行条例》（Crimes Ordinance 2014）规定“使用威胁性言语或行为，或展示任何威胁性书面材料，并意图以此煽动宗教仇恨或基于性取向之仇恨，可处以罚款或最高七年之监禁”[23]。《2014年刑事诉讼程序及证据条例》（Criminal Procedure and Evidence Ordinance 2014）允许法院将基于受害人性取向的犯罪视为加重处罚的因素[24]。此外，《2017年监狱条例》（Prisons Ordinance 2017）要求监狱工作人员不分性取向因素等平等对待所有囚犯[25]，《2017年通讯条例》（Communications Ordinance 2017）禁止发放煽动基于性取向的仇恨或歧视之材料[26]。

性别认同及表达 编辑

英国《2004年性别承认法令（英语：Gender Recognition Act 2004）》并未适用于福克兰群岛，而《2014年刑事诉讼及证据条例》规定“法律上，个人之性别为其出生时登记之性别，除非该人拥有依联合王国《2004年性别承认法》第9条颁发之证书，此种情况下，该人之性别为后天获得之性别”[24]。
