福克兰群岛同性婚姻

英国海外领土福克兰群岛的同性婚姻自2017年4月27日合法。允许同性伴侣结婚的法律于3月30日在立法议会通过，并于4月13日获总督柯林·劳勃斯御准。该属地还承认同性、异性的民事伴侣关系。

福克兰群岛是第7个同性婚姻合法化的英国海外领土，也是继皮特凯恩群岛（英语：Same-sex marriage in the Pitcairn Islands）与直布罗陀（英语：Same-sex marriage in Gibraltar）后第3个承认民事伴侣关系的英国海外领土。

背景 编辑

大不列颠王国于1765年首次声称对福克兰群岛拥有主权，英国、法国与西班牙定期在福克兰群岛驻军，直至1811年所有驻军撤出。1833年，英国重申其对福克兰群岛的主权，并邀请民间人士居住于群岛[1]。

《1949年婚姻条例》（Marriage Ordinance 1949）于1949年12月31日颁布，适用于福克兰群岛及南乔治亚和南桑威奇群岛。该条例规定了结婚执照的颁发，并授权福克兰群岛总督任命登记员来举行结婚典礼。该条例未明确禁止同性婚姻，亦未定义“婚姻”一语。不过依据普通法，同性婚姻自始就被视为无效（英语：Void (law)），因此同性伴侣无法在群岛结婚。该条例于1996年废除，并由《1996年婚姻条例》取代（Marriage Ordinance 1996），该条例在承认同性结合方面并无变化[2]。

同性婚姻法律 编辑

2015年5月13日，福克兰群岛检察总长马克·刘易斯（Mark Lewis）建议行政委员会（英语：Executive Council of the Falkland Islands）考虑将该属地内的同性婚姻或民事伴侣关系合法化[3]。2016年1月13日，委员会经公众咨询（英语：public consultation）后指示检察总长准备《婚姻条例》修正案，以允许同性婚姻[4]。公众咨询发现90%的受访者支持同性婚姻，94%的受访者支持所有伴侣建立民事伴侣关系[5]。

检察总长的修正案草案于2017年2月22日由行政委员会审议。委员会指示刘易斯在官方公报公布该修正案，从而开始一读立法程序，并准备实施所需的后续立法[6]。2017年3月30日，立法议会以7票同意对1票反对通过同性婚姻法案[7][8][9][10]，其中立法议会议员简·奇克（英语：Jan Cheek）、罗杰·爱德华兹（英语：Roger Edwards (politician)）、巴里·埃尔斯比（英语：Barry Elsby）、伊恩·汉森（英语：Ian Hansen）、麦可·普尔（英语：Michael Poole (politician)）、菲尔·伦德尔（英语：Phyl Rendell）、加文·肖特（英语：Gavin Short）同意[11][12]，迈克·萨默斯（英语：Mike Summers）反对，同性伴侣结婚及建立民事伴侣关系最终获允许[13][14][15][16]。该法案于4月13日获总督柯林·劳勃斯御准[17][18]，2017年4月29日生效[19]。庆祝同性婚姻合法化的社群活动于同日在斯坦利举行[11][20]

《婚姻条例》第3A(1)与3B条规定[21]：

同性伴侣之婚姻为合法。

依本条例结成之同性婚姻，须以等同男女婚姻之方式对待，并享有相同地位。

《释义及通则条例》（Interpretation and General Clauses Ordinance）亦经修订，声明“婚姻”包含依《1996年婚姻条例》举行或承认的同性婚姻，并声明所有提及“夫”、“妻”、“夫妻”的内容，以及所有其他条例中的“寡妇与鳏夫”应理解为包含同性伴侣。法律定义民事伴侣关系为“一男一女或两位同性（“民事伴侣”）登记为彼此之民事伴侣所形成之关系”。福克兰群岛承认在福克兰群岛以外（如英国本土）结成的民事伴侣关系[6]。

首例同性婚姻于2017年11月20日在彭布罗克角附近的克里斯蒂娜湾（Christina Bay）结成[22]。
