美国劳动法是美国一系列规范美国雇员、美国工会雇主之间的权利和义务的法律[1]1938年公平劳动标准法规定了美国全国的最低工资,但在29个州和华盛顿特区,该标准更高。不过目前没有联邦法律、也没有州法律就带薪假期或带薪产假与育婴假有过规定。[2]

美国一些雇员为了加强谈判实力,获得更好的待遇,进而组织工会与雇主进行集体协商克莱顿反托拉斯法保障了所有人组织工会的权利,全国劳资关系法赋予大多数雇员组织工会的权利,并让他们不会受到不当劳动行为的侵害。[3]

1964年民权法案颁布以来,所有雇主和工会都必须平等对待员工,不得因为“种族、肤色、宗教、性别或国籍”等因素歧视他们[4]1963年公平薪酬法案还就男女薪酬做出规定。[5]
